Medical malpractice lawsuit follows vaccination side effects

Although it is not a regular incidence, severe side effects can be experienced by individuals after being vaccinated. Pennsylvania residents may be interested to learn about the federal government’s National Vaccine Injury Compensation Program (NVICP), which was established many years ago and has processed over 14,000 claims since 2012. One such claim of medical malpractice was filed on behalf of a woman from Lehigh Valley who was asked by her employer to have a flu vaccination in 2010.

A week after the vaccination, the woman developed symptoms similar to the flu, which was followed by weakness and pain in her limbs. She consulted a physician and was diagnosed with a debilitating condition identified as Guillian-Barre Syndrome. Although not a common side effect associated with flu vaccines, this neurological condition has been known to occur after vaccination. It is apparently an incurable disease, but patients who take part in programs of rehabilitation can recover to some extent.

Negotiations with the NVICP on the behalf of the patient resulted in a settlement of $11.6 million. This will cover the woman’s ongoing rehabilitation at the Lehigh Valley clinic, along with lifetime expenses. For her pain and suffering, along with lost earnings, an additional $1 million is included. The NVICP obtains funds from a tax surcharge of 75 cents on each vaccination performed.

Residents of Pennsylvania who have suffered severe side effects after medication retain the right to file a medical malpractice lawsuit in a court of law. In successfully presented cases, the court may award monetary judgment to cover current and future expenses as deemed appropriate by state laws. Individuals needing long-term care may find comfort in knowing that their welfare will be secured by the monetary aid awarded.
