Motorcycle accidents: Wrongful death claim may follow fatal crash

Riders of motorcycles in Pennsylvania are likely aware of the risks they take whenever they share the roads with other vehicles. For unknown reasons, some drivers of cars and trucks find it difficult to keep a lookout for bikers and collisions occur frequently. Unfortunately, motorcycle operators and their passengers have little or no protection against severe injuries, and in many motorcycle accidents, they lose their lives.

Such a tragedy was reported by the Pennsylvania State Police on a recent Sunday evening. Although the accident investigation is ongoing, a preliminary crash report indicates that the biker was a 42-year-old man from Scottdale. Reportedly, he was eastbound on Route 31 when a sedan heading west made a left turn without yielding to the motorcycle.

The report says the 72-year-old driver of the car allegedly moved into the lane in which the biker was traveling before making the left turn. The collision that followed caused severe injuries to the biker. He was rushed to a hospital but succumbed to his injuries, and he was declared dead at the hospital.

It is naturally hard to cope with losing loved ones in motorcycle accidents that appear to have been avoidable. The surviving family members of the deceased victim of this crash will be entitled to pursue financial relief through the Pennsylvania civil court. A wrongful death claim can be filed against the driver deemed responsible. However, negligence will have to be established before the court will consider all the documented claims for financial and emotional damages brought about by the tragic crash.
